 We are forging ahead with the preparatory work for implementing the international trade mark registration system under the Protocol Relating to the Madrid Agreement Concerning the International Registration of Marks in Hong Kong.

Patent 

The Original Grant Patent system was launched in December 2019.  We will continue to enhance the substantive examination capability of our patent examiners, with a view to acquiring institutional autonomy in conducting substantive patent examination by 2030.

We have rolled out a pilot project with the China National Intellectual Property Administration in January 2023 to enable Hong Kong applicants to enjoy prioritised examination of qualified patent applications in the Mainland.

Mainland Cooperation Faciltation Measures 

The Government will take the lead in discussing with the patent agent sector and stakeholders to plan for the establishment of regulatory arrangements on local patent agent services, covering professional qualification requirements, registration, as well as the regulatory model and framework, with the aim of enhancing service quality and nurturing talents.

Design

To advance the policy objectives of promoting timely registration of designs, electronic filing and the use of registered designs to drive innovation, the fees of the Designs Registry have been reduced since 1 March 2024.  The level of reduction ranges from 10% to 70%.

A review of the existing registered designs regime is underway with a view to commencing consultation in 2025 on the way forward in updating the regime, so as to ensure that the regime closely follows the mainstream international practices and meets future local industrial development needs driven by the new industrialization and growth of the digital economy.

The Copyright (Amendment) Ordinance 2022 came into force in May 2023 to update the Copyright Ordinance (Cap.528) in order to strengthen copyright protection in the digital environment.

In view of the copyright issues arising from the rapid development of artificial intelligence (“AI”) technology, we launched a two-month public consultation on 8 July 2024 to explore further enhancement of the Copyright Ordinance regarding the protection for AI technology development to ensure that Hong Kong's copyright regime remains robust and competitive.
